JUSTIÇA RESTAURATIVA NA EXECUÇÃO PENAL: MEDIAÇÃO PENITENCIÁRIA E CONDIÇÕES DE EFETIVIDADE

In the light of the well-known crisis of the Brazilian prison system, this article examines the insertion of Restorative Justice into the field of criminal sentence enforcement, combining three layers of analysis: the paradigm shift that grounds it, the international and Brazilian normative framework that authorises and limits it, and the practice of prison mediation as experienced by the author at the Madrid V Penitentiary Centre, Soto del Real (Spain). It argues that sentence enforcement is the ground of least dogmatic resistance to restorative practice, since responsibility has already been judicially declared, and what remains in dispute is only the manner of serving the sentence and the fulfilment of its statutory purposes. Drawing on the international resolutions and on Resolution 225/2016 of the Brazilian National Council of Justice and its subsequent amendments, the article sets out the prerequisites, principles and procedural safeguards that separate restorative practice from a procedural trap. It then describes the concrete design of Spanish prison mediation, together with its outcomes and its persisting limits. Finally, the work addresses the conditions on which the effectiveness of the practice depends — the romanticisation of Restorative Justice, the idealisation of community, the risk of governmentalised restorativeness, the real obstacles to victim participation, and the caution required in high-complexity contexts, treated not as objections to Restorative Justice but as the points at which its implementation tends to fail. An implementation roadmap for the Brazilian case is proposed in closing. It concludes that transposing the Spanish model to Brazil depends on material and institutional conditions that are not yet in place, and that acknowledging these conditions does not weaken Restorative Justice: it protects it from being sold as something it is not yet.
