Résumé

O conceito de nudge como apresentado por seus ideólogos tem recebido grande atenção da literatura e dos agentes políticos desde a publicação do livro inaugural do tema por Thaler e Sustein em 2008. Esta intervenção que se apoia nos ideais da economia comportamental, vem sendo utilizada como estratégia regulatória e de políticas públicas orientando a ação individual para promoção do bem-estar social, sobretudo nos campos de saúde, alimentação, meio ambiente e finanças. Muito embora seja inegável o nudge tenha trazido bons resultados em áreas diversas, principalmente tratando-se do uso de cláusulas default, estudos tem mostrado que essa estratégia possa não ser tão eficaz, de baixo custo e facilidade de implementação como proclamado. Esse estudo busca, através do novo conceito de nudgeability, trazer insights para a otimização da utilização do nudge como estratégia regulatória, bem como jogar luz em aspectos críticos para suas condições-limite de uso como política pública e regulação.
